A complete course of study providing education and training to allow the student, to learn how to deal with the Fair Claims Settlement Practices statutes and state regulations created to enforce compliance with the Good Faith Settlement Practices Regulations.  The course will review and explore the various state regulations and the need for every claims person and every claims supervisor, manager, or Vice President of Claims, to fulfill the requirements of the regulations.

This fourteenth course in the series provides a representative of an insured or the representative of the insurer with sufficient knowledge to work together to complete a thorough investigation of a third-party liability claim in compliance with the Fair Claims Settlement Practices statutes and regulations.

The Course covers the following:

  1. The Fair Claims Settlement Practices statutes.
  2. The reason the Regulations were imposed.
  3. The Regulations created to enforce the provisions of the Fair Claims Settlement Practices statutes.
  4. A detailed review of the California State Regulations since they are the most comprehensive and strict fair claims settlement practices regulations in the country.
  5. How complying with the regulations make the investigation and resolution of a liability claim easy to complete properly.
  6. The type of claim not covered by the Regulations.
  7. How suspected fraud limits and excuses parts of the Regulations.
Learning Objectives
  • Identify what the Regulations enforce.
  • Explore how a claims person must be trained on compliance with the Regulations.
  • Recognize the time limits imposed on a claims investigation by the Regulations.
  • Recognize how liability insurers investigate a claim to determine if there is any basis for asserting defenses to the claims against the insured while fulfilling the requirements of the Regulations.
  • Identify each of the requirements set by the Regulations to investigate, to inform the insured of the available coverages, and to deal fairly and in good faith with the insured and claimant.
  • Discover each requirement of the Regulations.
  • Discover how to fulfill all of the requirements of the Regulations.
